Your consent to receive SMS or email communications is entirely voluntary and is not a condition of any purchase, account registration, or use of our services. You may use the Service and maintain your account without enabling SMS or email communications.
By providing your mobile phone number and affirmatively enabling SMS notifications within your account settings, you provide your prior express written consent to receive recurring automated text messages from Refined Catalyst Solutions, LLC at the mobile phone number you provide. This consent satisfies the requirements of the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations.
Opt-In Confirmation: Upon enrollment, we will send you a confirmation text message to verify your opt-in. This confirmation will include the program name, message frequency disclosure, opt-out instructions (reply STOP to cancel), help instructions (reply HELP), and a link to our Privacy Policy.
Message Frequency: Message frequency varies depending on market activity and your notification preferences. You may receive approximately 1 to 6 messages per day. Actual frequency may be higher or lower depending on market conditions.
Message & Data Rates: Standard message and data rates may apply depending on your mobile carrier and plan. Refined Catalyst Solutions, LLC is not responsible for any messaging or data charges imposed by your wireless carrier. Contact your carrier for details about your specific plan.
Consent Recordkeeping: We maintain records of your SMS consent, including the date and time of opt-in, the method used, your IP address, and the exact disclosure language presented to you at the time of consent. These records are retained for a minimum of five (5) years from the date of consent or the date of your last interaction with our SMS program, whichever is later.
You may revoke your consent and opt out of receiving SMS communications at any time through any reasonable means, including but not limited to the following methods:
Processing Time: We will honor your opt-out request as soon as practicable, and in no event later than ten (10) business days from the date we receive your request. You may receive additional messages during this processing period.
Confirmation Message: After receiving your opt-out request via text, you may receive a one-time confirmation message within five (5) minutes. This confirmation message will not contain any promotional or marketing content. If you do not respond to the confirmation, your opt-out will be processed as a full revocation of consent for all SMS communications.
Continued Access: Opting out of SMS messages will not affect your ability to use the Service, access your account, or receive non-SMS communications from us (such as email notifications). You may re-enroll in the SMS program at any time by re-enabling the SMS toggle in your account settings.
Opt-Out Records: We retain records of all opt-out requests indefinitely to ensure we do not inadvertently re-enroll you in our SMS program without your express consent.
We will not send promotional or marketing SMS messages before 8:00 AM or after 9:00 PM Eastern Time. Transactional or service-critical alerts (such as account security notification) may be sent outside of these hours when reasonably necessary.

Our messaging service provider is contractually obligated to protect your information and use it only for the services it provides to us.
You may receive email communications related to your account and services.
You may unsubscribe from marketing emails at any time using the unsubscribe link included in such emails. Transactional or service-related emails (such as account confirmations or security alerts) may still be sent as necessary.
Wireless carriers are not liable for delayed or undelivered messages.
Message delivery is subject to carrier availability, network conditions, and device compatibility. Our SMS program may not be available on all wireless carriers or devices, and supported carriers may change without notice. Refined Catalyst Solutions, LLC is not responsible for any charges imposed by your wireless carrier in connection with SMS messages.

All content, features, and functionality of the Service are owned by Refined Catalyst Solutions LLC and are protected by applicable intellectual property laws.
You may not copy, reproduce, or distribute any part of the Service without prior written permission.
We do not guarantee uninterrupted or error-free operation of the Service.
We may modify, suspend, or discontinue any part of the Service at any time without notice.
The Service is provided “as is” and “as available.”
We disclaim all warranties, express or implied, including:
We do not guarantee the accuracy, completeness, timeliness, or reliability of any market data, price information, or alerts delivered through the Service or via SMS.
To the maximum extent permitted by law, Refined Catalyst Solutions LLC shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of data, or business interruption, arising from your use of the Service, reliance on any market data or alerts, or any SMS or email communication. Your use of the Service is at your own risk.
You agree to indemnify and hold harmless Refined Catalyst Solutions LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

These Terms and the Privacy Policy should be read together. In the event of any conflict between these Terms and the Privacy Policy regarding SMS communications, these Terms shall control.
We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service will cease immediately. Termination of your account does not relieve us of our obligation to honor any prior opt-out requests related to SMS communications.
These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles.
We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. We will make reasonable efforts to notify active users of material changes to the SMS program terms.
Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
